Cascade Mortgage Capital Inc. (“Cascade”) is a full service mortgage brokerage working with clients to find the most suitable mortgage, loan or credit facility. Cascade offers relatable products and services such as mortgage insurance. Cascade is an independently owned and operated mortgage brokerage with no affiliations to networks or institutions.

The Cascade team and ownership know that privacy protection is crucial to our clients and partners, and on this basis we have taken steps to introduce policies and procedures that will protect any personal information that is provided to Cascade. We use a range of business procedures and security measures to maintain confidentiality and secure storage of your information. Your data will only be used for the purposes defined in this Privacy Policy. The purpose of this policy is to provide responsible and transparent practices for personal information management and to ensure we satisfy the requirements established by the Personal Information Protection and Electronic Documents Act (PIPEDA).

Application

The Privacy Policy generally applies to any personal information as it is defined below in the section “Definition of Personal Information”. This accounts for information that is collected or generated by Cascade, its brokers or anyone acting as an agent on our behalf (“Authorized Agent”), from or regarding its clients and other individuals with which it deals, this may include potential clients as well as any other additional person named on an account, in any form. Any time that you conduct business with Cascade, participate in a Cascade run promotion or contest, a Cascade broker or with an Authorized Agent, or interact with us in any fashion, the rights and safeguards outlined within this Privacy Policy protects you, and you explicitly agree to its terms. 

This Privacy Policy also governs personal information that is collected regarding Cascade website users and informs how we use and disclose personal information that is collected from users who visit our website or otherwise interact with us through www.cascademortgagecapital.ca (“website”). It also explains how we use cookies and similar resources and/or technologies.

Definition of Personal Information

When used in this Privacy Policy, personal information refers to “any information about an identifiable individual”. This can include your name, contact information, email address, information relating to your account with us, including your identity and the mortgage you acquire, as well as your credit and banking information, billing records and any complaints documented on file. It can also include other types of more technical information that is captured when interacting with us on our website, when this information can identify you as an individual. Personal information that is collected, but cannot be associated with an identifiable individual is deemed to not be personal information. 

Collection and Use of Personal Information

The majority of information that is collected about you is received directly from you, with your consent.

The data we usually collect includes your name, address, phone number, email address, occupation, employer’s name, date of birth, annual income, net worth, assets, liabilities, credit history, investment goals, banking information, as well as other account and payment information, including information related to your use of products and services when you register as a client of Cascade. Additional information may be necessary to be collected. This can include documentation such as your driver’s license, social insurance number or passport number, as required and/or authorized by law. An example of this would be to fulfill regulatory obligations or other governmental requirements, and to identify you when other clients have similar names. 

Your information may also be collected from third party sources, this will only be done with your consent. For example, we may need to pull your credit report from an independent credit reporting agency in order to assess your creditworthiness, this may also include account information. In order to determine which mortgage product best fits your needs and financial situation, Cascade will utilize your credit report to determine your fit with different lenders before submitting your application. If there is a need to capture information regarding beneficial owners, intermediaries or other third parties, we may also collect personal information from third parties, such as your spouse, in order to fully understand the dynamic and various factors impacting the situation. 

Cascade generally collects personal information from or about its clients and other individuals with whom it deals for the following purposes:

  • To verify a client’s identity, a client’s eligibility for Cascade’s products and services, and a client’s credit that is to be used in qualification for Cascade’ products or services;
  • To complete applications and/or requests that clients initiate, in order to provide products or services that are requested, and to certify that all related transactions are supported and implemented;
  • To manage its business, establish, develop and maintain business relationships, to monitor, review and improve client services, respectively with Cascade clients and other individuals with whom it conducts business;
  • To respond to client and/or vendor inquiries, and to create, establish and implement client mortgage financing or accounts;
  • To maintain quality, and internal training procedures, to meet legal and regulatory requirements as set forth by the Financial Services Regulatory Authority of Ontario and other regulatory bodies, and to allow Cascade to meet its contractual obligations regarding products and services that are provided to clients;
  • To evaluate and analyze the interests, wants and needs of our clients and to ensure we stay relevant within said needs as they change by improving our products and services that we provide to customers;
  • To provide tailored products and services that fit within the needs and scope of our clients, as well as to effectively recommend such products and services; and
  • Subject to the clients Right to Withdraw Consent, we intend to conduct surveys on the quality of the products and services or customer service that we provide and to provide our clients with offers for additional products and services that we feel will be of interest to our clients or products and services that we feel meet our client’s changing needs.

As a prospective employee, you may submit a resume and/or application to the Cascade team, the personal information submitted within your job application will be used for recruitment and other traditional human resources practices. Unless legally obliged, Cascade will not collect or use personal information for any other or new purpose without obtaining the consent to do so. Cascade offers you the opportunity to use mortgage calculators in order to assess different borrowing scenarios, these mortgage calculators are designed to collect information about you and/or your financial situation. The details are used to establish a profile based on your scenario with a view to helping you choose the most suitable product for your needs.

Your Consent

There are various means of obtaining consent that Cascade utilizes; this pertains to the collection, use and disclosure of personal information. The most common method for obtaining a client’s consent is through the use of our client consent form. As the situation requires, we may also obtain a client’s consent through electronic communication or other written documentation.

You are providing consent to the collection use and disclosure of your personal information when requesting Cascade products and services and/or submitting your information to us in connection with the use of Cascade products and services based on this Privacy Policy and the Cascade contractual documents. Furthermore, by visiting, using and/or interacting with our website, online mortgage application, or mortgage calculators you agree to benefit from, and be bound by, the terms and conditions of this Privacy Policy. 

Under extenuating circumstances, personal information may be collected, used or disclosed without consent. These exceptional circumstances may include:

  • To comply with a court order, subpoena or warrant, or as required or authorized by law or a regulatory body that is operating within their jurisdiction; 
  • To collect an outstanding debt; 
  • And in order to collect, use or share data for the purposes of detection, prevention of, or remediation of a breach of an agreement, fraud or other illegal/criminal activity, and whereby the collection of consent may serve as a warning to the perpetrator and as such defeat the purpose of collecting the information.

Right to Withdraw Consent

With reasonable notice you may request that your consent be removed, although this is subject to legal or contractual restrictions. Depending on the circumstances, consent withdrawal or amendment may prevent Cascade from providing you with Cascade’s products and services or information that may be of value to you. In order to withdraw your consent please conduct the following steps:

Email communications – click the “unsubscribe” or “opt-out” button at the bottom of any commercial electronic communication we send you. Note, if you opt-out of promotional communications, we may still need to contact you with information about your account.

For all other communications, please provide a request in writing (electronic communications qualify) requesting to be removed from our promotional communications. Please provide 15 business days to allow us to remove you from our promotional communications list, as this should allow sufficient time for any communications pending delivery to be cleared through the backlog. 

Sharing of Personal Information

Your information may be made available by Cascade to Authorized Agents or agents in a co-brokerage arrangement or service providers to fulfill the purposes for which it was collected or as outlined in this Privacy Policy. Cascade will not sell, rent or trade your personal information to any third party. However, we may share your personal information when authorized by law or as follows: 

Financial institutions and Credit:

Your personal information may be disclosed to financial institutions in connection with the application, management and administration of the product and service that you have requested. This may include your credit file to credit reporting and assessment agencies, insurers or other lenders, as applicable given the situation at hand. 

Most products and services we offer are provided through industry partners and not directly by Cascade, for example, in some cases we rely on credit assessment agencies to determine credit worthiness, real estate appraiser to determine property values, financial institutions to provide loan and mortgage products, insurance agents and brokers to provide insurance products, public registers to verify beneficial ownership, employers to verify an applicants employment status, industry professionals for various mortgage related services, affiliated companies and other third parties to provide Cascade with products and services on your behalf or to provide you with products and services. 

As a result, we may provide your personal information to such providers or agents in order to ensure that you are able to receive the requested products or services. These industry partners are provided with the information that they require in order to provide you with the products and services that you require. These industry partners are prohibited from using the information that is shared with them for any purpose other than facilitating and carrying out the products and services that they were engaged to provide. These industry partners are also prohibited from disclosing any information to others. 

Affiliated Entities:

Your personal information may be shared with third parties for legal and regulatory purposes. It may also be shared with third parties to conduct analysis to facilitate a more suitable and relevant range of products and services to better manage your relationship with us. 

As permissible or required by law, Cascade may disclose your personal information when compelled to do so in response to a law, regulation, court order, subpoena, valid demand, search warrant, government or law enforcement investigation, or other legally valid request or enquiry. 

Personal information may also be disclosed to auditors, agents, lawyers and accountants contracted by Cascade in connection with the enforcement or protection of our legal rights. Cascade also reserves the right to report to any applicable regulatory authority or law enforcement agencies any activities that we, in good faith, believe to be unlawful or to law enforcement and emergency services providers in the event of an emergency or where required or permitted to do so by law.

In the event that we deem it necessary to do so, personal information may be released when we have reasonable grounds to believe that such a release is reasonably necessary in order to protect the rights, property and safety of others and ourselves, in accordance with or as authorized by law or the appropriate regulatory authority. 

Business Transaction:

In the event of a sale or transfer of business or assets, a merger or consolidation, reorganization or financing of parts of our business personal information may be disclosed to a third party under the terms of said transaction and protection of a Non-Disclosure Agreement. In the event of a completed transaction, your personal information will remain protected by applicable privacy laws. Should the transaction not complete, the other party will be required to not use or disclose any information provided in any manner whatsoever and to completely delete and/or destroy any such information that is in their possession, failure to do so will result in legal action based on the terms of this Privacy Policy and the terms of the Non-Disclosure Agreement. 

In the event that an individual is reasonably deemed to be acting on behalf of another party or client of Cascade, such as a power of attorney, Cascade will disclose the personal information.

Business Analytics

Any aggregate data that is captured through the use of the Cascade website may be shared with our partners, however this data does not allow identifying individual clients or users, and is only used to provide our partners with a better understanding of our general client profile in relation to the products and/or services and users of our website, industry trends, or similar information. We do not link aggregated information with personal information. 

Website Privacy

Cascade generally collects and uses personal information from or about its website visitors users as follows:

  • Information as provided from our clients. In most cases, we collect personal information directly from our clients when they visit or use our website. For instance we may collect the following type of information:
    • Inquiries: As you make inquiries about products or services, we may collect information such as your name, contact information, and any information you provide to us when making said inquiry or contact us through our website. This information is used to provide you with the answer or products and services that you request or to contact you in order to address your concerns. 
    • Registration: In order to receive promotional electronic communications, you must first complete a registration form and provide us with the appropriate contact information. If you wish to subscribe to promotional electronic communications your name and email address will be used to send you promotional communications. There is an option to unsubscribe in the email, you may also contact us directly by email to request your removal from the promotional communications. Note, we may need to maintain contact with you in relation to the products and services that you are receiving from Cascade. 
    • Application Forms: Your name, contact information, and any other information you provide us when completing an online request for a mortgage, request for other products, services, application, online pre-qualification, refinancing and/or renewal application forms available on our website. This information will only be used to inform you of our products and services or to process and answer your request or to manage our everyday business needs in connection with such requests. If an application is filed on our website, we require that certain personal information be provided, including your name, address, phone number, email, and current employment data. This is necessary for Cascade to effectively process your application and to contact you. Although a social insurance number is not required to accept an online application, you may choose to provide this in order to expedite the processing of your application. 
    • Satisfaction Survey: When you visit the Cascade website, you may be invited to complete a survey regarding your satisfaction with our services. You can participate at your discretion, although if you do participate we may collect your postal code, email address and any additional information that is necessary to complete the survey. This information enables us to assess our client service level as well as gathering information regarding concerns that our clients may have. A member of the Cascade Management Team may contact you if we determine that the comments you have made require further clarification or investigation. If we are using a third party service provider to manage and conduct surveys or contests, that service provider is prohibited from using your personal information for any other purpose. Your personal information that is captured in the survey will not be shared with other third parties unless you have been given prior notice, and chosen to participate. 
    • Technical Information: Cascade utilizes technology such as cookies in order to assist with the collection of technical information. This may include data regarding your visit to our website, your IP address, the browser and operating system used to view our website, the screen resolution at the time, your location, language settings and the site that you came from. If you are arriving from a search engine we will capture the keywords searched, the number of page views, information entered and advertisements viewed, etc. This data helps us to determine your approximate location, in order to measure and improve the effectiveness of our website or enhance the experience of our clients. For example, we may use this data to verify that the products or services we are offering or promoting are available in your region, or to ensure that our advertising campaigns are relevant to you and not overly repetitive.       • Google Analytics: Cascade utilizes Google Analytics in order to assess information regarding user website activity, this includes page views, source, time spent on our website and more. The information we view is not associated with a client or account and is displayed as numbers, this means it cannot be tracked back to individuals. You may opt-out of the use of Google Analytics by visiting the opt-out page on Google Analytics.
      • Google AdWords: Cascade utilizes Google AdWords Remarketing in order to promote Cascade across the internet and to advertise on third party websites to previous visitors to our website. AdWords Remarketing will display our ads to you based on what parts of the Cascade website you interacted with by placing a cookie on your web browser. This could mean that we advertise to previous website visitors who did not complete a task on our website, this could also be in the form of an ad on a Google search results page, or a site in the Google Display Network. You are not identifiable by the cookie in any way and we do not have access to your computer or mobile device through the cookie. The cookie is only used to indicate to other websites that you visited a page on our website in order to show you ads relating to the page that you visited. Quality and Access Rights

Cascade is committed to ensuring that your information is accurate, complete and up-to-date when considered in relation to our purposes of use for your information. As a result, Cascade enables its clients to access their personal information and make corrections and amendments to any inconsistent or inaccurate information. Clients can do so by contacting us using the information detailed in the Contact Us page on our website, or this Privacy Policy. Cascade has the right to refuse a request for access to personal information if the information falls under one of the following circumstances; it is protected by a legal privilege, granting access would result in Cascade revealing confidential commercial or business information, the information was collected with the purpose of fraud detection and prevention, the information was generated as a result of a formal dispute resolution process, the information would result in Cascade revealing personal information about another individual, the request is reasonably deemed to be frivolous, or any other reason that is authorized by applicable laws. 

Personal Information Outside of Canada

Cascade may subscribe to third party service providers that transfer, process and store data outside of Canada, as a result, the personal information that we collect and manage may fall under this category. As a result of the storage location, this information may be available to government authorities under lawful orders or laws applicable in that jurisdiction. 

Security of Personal Information

Although no method of electronic storage or method of transmission over the internet is 100% secure, Cascade will employ reasonable security measures in order to protect your personal information from unauthorized access and use. Cascade has implemented security measures that contain physical, technical and administrative controls which are designed to protect your personal information. 

Retention
